This matter came to be heard by this Honorable Court on this the 18 day of January, 2023. Upon Counsel's MOTION FOR SERVICE BY PUBLICATION this Honorable Court finds as follows:

1. That the current whereabouts of the Respondent, Ethan Dean (hereinafter "Respondent"), are unknown.


2. That the Petitioner, Sherry Martinez, has made diligent efforts to locate the Respondent.


3. That pursuant to Tenn. Code Ann. § 21-1-203 and 21-1-204 that proper service on the Respondent will be satisfied through Service by Publication.


4. That The Knoxville Focus is a regularly published and distributed newspaper in Knoxville, Tennessee, which is the most proximate location of the Respondent's last known location.


5. That The Knoxville Focus, IS the proper media forums for Service by Publication.


6. That Service by Publication through The Knoxville Focus, for four (4) consecutive weeks, satisfies all of the Service requirements set forth by Tenn. Code Ann. § 21-1-203 and 21-1-204.

IT IS THEREFORE, ORDERED, ADJUDGED, AND DECREED AS FOLLOWS:

1. That the Respondent shall be served with proper notice by Publication through The Knoxville Focus.


2. That notice shall run one (1) time per week for four (4) consecutive weeks in The Knoxville Focus, ending no later than six (6) days prior to the Hearing as set forth in this Order, thereby satisfying the Service requirements set forth by Tenn. Code Ann. § 21-1-203 and 21-1-204.


3. That if Respondent does not file an answer with the Clerk and Master of the Chancery Court of Union County, Tennessee and with Petitioners' Counsel, Zachary J. Redden, whose address is

8 Emory Place, Knoxville, Tennessee 37917, within thirty (30) days of the last date of publication of this notice that a Hearing will be set for this cause before the Honorable Chancellor, Elizabeth C. Asbury, at the Union County Chancery Court, located at 901 Main Street, Suite 206, Maynardville, Tennessee, 37807, that action shall be taken by this Honorable Court to default the Respondent, and enter Judgment in favor of the Petitioners, Sherry Martinez and Jose Martinez.

4. That Judgment in favor of the Petitioners, Sherry Martinez and Jose Martinez, will result in the termination of the respondent's parental rights and the adoption of the minor-child, CORBIN MOSER DEAN, in accordance with a separately filed Petition to Terminate Parental Rights and for Adoption.

This cause came to be heard on January 12, 2023, upon the Petition to Sell and Confirm the Sale of Real Property filed by Cindee H. Lambo, Administrator of the Estate of Nancy Leona Carr, deceased, by and through counsel, Fiona F. Hill, filed on December 8, 2022, and an Amended Petition to Sell and Confirm the Sale of Real Property filed on January 11, 2023. Pursuant to T.C.A. §21-1-204, it appearing from the allegations in the Petition and Amended Petition, being duly sworn to, that all identified heirs listed below, any unknown heirs of the Estate of Nancy Leona Carr, and any other persons or parties unknown claiming any right, title, estate, lien, or interest in the real property described in the Petition and Amended Petition, cannot be served with ordinary process of law as their whereabouts cannot with due diligence be ascertained. The Court found the Petition to be well taken, but determined that prior to granting the relief sought to sell the real property identified therein, that Service by Publication was necessary in order divest all right, title, and interest, legal and equitable, in the property to be sold and to vest clean title and interest in each purchaser identified therein. These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Knox County Grants & Community Development

REQUEST FOR RELEASE OF FUNDS

On or about March 14, 2023 the Knox County KCGCD will submit a request to the Tennessee Department of Economics and Community Development for the release of Block Grant Funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake a project known as Little Vols Learning Center Acquisition Project for the purpose of acquiring an existing preschool and daycare facility located at 7533 Oak Ridge Highway, Knoxville, in Knox County, TN. If released, $400,000.00 in HUD Community Development Block Grant will be used to assist to assist in the purchase of the property to retain its current use.

FINDING OF NO SINIFICANT IMPACT

The Knox County KCGCD has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at https://www.knoxcounty.org/communitydevelopment/public_notices.php and may be examined or copied weekdays 8:00 A.M. to 4:30 P.M.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the CDFeedback@knoxcounty.org.  All comments received by 3/13/2023 will be considered by the Knox County KCGCD prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION

The Knox County KCGCD certifies to the Tennessee Department of Economic and Community Development that Mayor Glenn Jacobs in his/her capacity as County Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce the responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Tennessee Department of Economic and Community's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Knox County KCGCD to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

The Tennessee Department of Economic and Community Development will accept objections to its release of fund and the Knox County KCGCD certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Knox County KCGCD (b) the Knox County KCGCD has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the Tennessee Department of Economic and Community Development; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Tennessee Department of Economics and Community Development, Community and Rural Development, 312 Rosa L. Parks Avenue, 27th Floor, Nashville, Tennessee 37243-1102. Potential objectors should contact Community and Rural Development to verify the actual last day of the objection period.
